Vibecouture, accessible at vibecouture.shop, respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have implemented a formal procedure to address claims of copyright infringement occurring on our website.

As an online retailer of high-quality women's Dress Shirts and fashion apparel, we use a variety of original images, text, and designs. We will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent, identified below.

1. Notice of Copyright Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Agent.

Upon receipt of the Notice as described below, Vibecouture will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

2. Requirements for DMCA Notice

To be effective, the notification must be a written communication that includes substantially the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., specific URLs).
  • Information reasonably sufficient to permit Vibecouture to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification Procedure

If you receive a notification that material you posted on the Site has been removed due to a copyright complaint, you may file a counter-notification with our Designated Agent. To be effective, a counter-notification must be a written communication that includes your physical or electronic signature, identification of the material that has been removed, and a statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.

5. Action Taken Upon Verification

Once a valid DMCA notice is received and verified, Vibecouture reserves the right to:

  • Remove or disable access to the infringing material immediately.
  • Notify the content provider, member, or user that we have removed or disabled access to the material.
  • Terminate the accounts of repeat infringers in appropriate circumstances to protect the integrity of our platform and intellectual property laws.

6. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We strongly recommend consulting with a legal advisor before filing a notice or counter-notice.
